Restoration Rescue is a free referral service that helps connect homeowners, property managers, and other property owners with independent, third-party restoration contractors that may serve their area. Restoration Rescue is not a restoration company, contractor, or provider of restoration services, and does not perform any cleanup, mitigation, remediation, repair, reconstruction, or other work. Our role is limited to helping connect you with independent contractors.
3. Independent Contractors
Any contractor or service provider you are connected with through Restoration Rescue is an independent third party. Restoration Rescue does not employ, control, supervise, endorse, or guarantee any contractor or the work they perform. We make no representation or warranty regarding the qualifications, licensing, insurance, availability, pricing, workmanship, or conduct of any contractor.
It is your responsibility to independently verify that any contractor you hire holds the necessary licensing and insurance required for the work being performed, and to evaluate whether the contractor is suitable for your needs. Any agreement, transaction, or dispute is solely between you and the contractor.
4. No Warranty
The Website and our referral service are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Restoration Rescue does not warrant that the Website will be uninterrupted, error-free, or free of harmful components, or that any contractor connection will meet your expectations or result in satisfactory work.
5. Phone Calls, Recording, and Communications Consent
When you call the phone number provided on the Website, your call may be routed, tracked, and recorded for quality assurance, training, attribution, and business purposes. By calling, you consent to the tracking and recording of your call.
By providing your telephone number or contacting us, you agree that Restoration Rescue and the contractors you are connected with may contact you by phone, text message, or other means regarding your inquiry, including through automated technology where permitted by law. Message and data rates may apply. You may opt out of further communications at any time. Your consent is not a condition of any purchase.

You agree to use the Website only for lawful purposes. To the fullest extent permitted by law, the total liability of Restoration Rescue for any claim arising out of or relating to these Terms or your use of the service shall not exceed one hundred dollars ($100).
9. Indemnification
You agree to indemnify, defend, and hold harmless Restoration Rescue and its owners, affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the Website, your connection with or hiring of any contractor, your violation of these Terms, or your violation of any rights of a third party.
10. Dispute Resolution and Arbitration
Please read this section carefully, as it affects your legal rights. Any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or our service shall be resolved through binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court where eligible.
You and Restoration Rescue agree to waive any right to a jury trial and to waive any right to participate in a class action or class-wide arbitration. Arbitration shall be conducted in the State of Wisconsin, or another location mutually agreed upon, and shall be governed by applicable arbitration rules. This provision does not prevent either party from seeking injunctive or equitable relief where appropriate.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law principles. Subject to the arbitration provision above, you agree that any legal action shall be brought exclusively in the state or federal courts located in the State of Wisconsin.

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of the Website after changes are posted constitutes your acceptance of the revised Terms.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
